Objects of industrial property include inventions, utility models and industrial designs. Industrial property rights are protected by a patent, which is issued based on the results of the examination conducted by the registration authority.

An author is a natural person, whose creative work resulted in the creation of an invention, a utility model or an industrial design. If several natural persons took part in the creation of the object of industrial property, all of them shall be deemed to be its authors (co-authors). The procedure for the use of rights belonging to co-authors shall be determined by agreement between them.

Patentee – the owner of the patent. It may be the author himself or the author’s employer, jointly the author and the right holder, subject to the agreement between them.

In case of a patent for invention, utility model of the Republic of Kazakhstan, the patentee shall have the exclusive right to use the protected object at his own discretion.

The manufacture, use, import, sale, offer for sale, sale, other introduction into the civil turnover or storage for that purpose of a product containing the protected object of industrial property, as well as the use of the protected process shall be deemed to be the exploitation of the object of industrial property.
