Challenging the unlawful registration of a trademark
We helped a dairy plant cancel a trademark registration that infringed the client's rights to its product packaging.
Result: Competitor's registration cancelledA dairy plant that held a patent for its product packaging approached us. It later emerged that the plant's supplier had registered the same packaging as a trademark.
Such a registration created serious risks for the business: restrictions on using its own packaging, possible claims, commercial losses and reputational consequences.
We analyzed the client's rights, prepared a legal position and filed a complaint with the Appeals Board at the Ministry of Justice of the Republic of Kazakhstan.
The complaint was granted. The registration of the trademark that infringed the client's rights was cancelled.
